Ovia Health’s Mother’s Day 2024 Giveaway Rules

This sweepstakes is sponsored by Ovuline, Inc. dba Ovia Health (the “Sponsor”), in collaboration with Newton, Baby Brezza, VTech, Mustela, Sam’s Club, Bugaboo, Contours, and Sealy (the “Participating Partners”). No purchase necessary. Making a purchase will not increase your chances of winning. Void in Colorado, Washington, and Nevada and where prohibited by law.

HOW TO ENTER 

To enter, between 12:00 am EST on April 12, 2024 and 11:59 pm EST on May 12, 2024 (the “Promotion Period”), submit an online entry at https://www.oviahealth.com/giveaway/april-giveaway-2024 for the chance to win the prize(s) described below. 

Alternatively, you may submit an entry on a single piece of paper with the following required complete, printed information: Name of this sweepstakes, your first name, your last name, and your e-mail address. Mail to Sponsor at the address listed below. No mechanically reproduced or photocopied entries accepted. Each entry must be mailed separately in a stamped envelope. Entries become the property of Sponsor and will not be returned. Entries must be postmarked by April 12, 2024 when the sweepstakes ends and must be received by Sponsor by May 19, 2024.

By submitting an entry, you will be entered into this sweepstakes. By entering, entrants agree to be bound by the terms of these Official Giveaway Rules.

ELIGIBILITY

To be eligible to participate in this sweepstakes, you must be a natural person 18 years or older and a legal resident of the 50 United States (excluding Colorado, Washington, and Nevada) or the District of Columbia as of the date the Promotion Period begins, as stated above. Residents of Colorado, Washington, and Nevada, employees of the Sponsor, the Participating Partners, their subsidiaries, affiliates, and members of their immediate families (including spouses, parents, children, siblings) and/or those living in the same household of each of the above are not eligible to participate. You may enter only once. Use of any robotic, automatic, programmed, or similar entry method or entering more than once will void all entries and result in disqualification. You may not enter more than once by using multiple e-mail addresses, identities, methods of entry, or devices in an attempt to circumvent these Official Rules.

DRAWING

A random drawing will be conducted on or about May 19, 2024 by Sponsor to select four (4) winners from among all eligible entries received during the Promotion Period. Odds of winning depend on the number of entries received. Sponsor will notify the potential winner by e-mail by May 26, 2024 and the potential winner will then have a maximum of 48 hours to respond and provide any information required by Sponsor for verification of eligibility and for acceptance of the prize. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may also result in disqualification and an alternate winner may be selected. Should Sponsor determine, in its sole discretion, that a new winner will be selected, Sponsor will conduct another random drawing from among the remaining eligible entrants. To obtain the name of the winner(s), mail a request with a self-addressed, stamped envelope to the Sponsor at the address listed below by May 19, 2024.

DATA USAGE

By submitting an entry, entrants give their express permission for Sponsor to contact them for purposes of notification of winning the prize. [In the event that they are a prize winner, entrants give their express permission for Sponsor to share their information with Participating Partners so that the Participating Partners may facilitate and deliver the prize to the winner. 

Additionally, entrants who submit an online entry give their express permission for Sponsor to share the information they included in their entry form (including but not limited to  e-mail addresses) with Participating Partners for marketing and promotional purposes. 

Once Sponsor shares the entrant’s information with Participating Partners for the purposes described in this section, all use of that information is then subject to the Participating Partners’ privacy policies.

Additionally, entrants give their express permission for Sponsor to share their name with individuals requesting a list of winner(s) name(s) as described in these Official Giveaway Rules. 

Personal information collected through this sweepstakes is also subject to Ovia Health’s Privacy Policy located at https://www.oviahealth.com/dynamic-privacy. By entering this sweepstakes, you agree to the use of your personal information as described in these Official Giveaway Rules and in Ovia Health’s Privacy Policy. 

CONDITIONS

All taxes (federal, state or local if any) and other expenses associated with the acceptance and/or use of any prize are the sole responsibility of the prize winner(s). Sponsor reserves the right to substitute any prize or portion of a prize for a prize of equal or greater value in its sole discretion. Prizes are not redeemable for cash and are non-transferable. Sponsor will not replace a lost or stolen prize. 

By entering this sweepstakes, entrants waive all right to, and hold the Sponsor harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The Sponsor will not be responsible for, without limitation: late, incomplete, illegible, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this sweepstakes; by any human error which may occur in the processing of the entries in this sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the sweepstakes, or announcement of the prize(s). If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel or modify this sweepstakes in a manner deemed appropriate by the Sponsor. 

ADDITIONAL TERMS

The parties waive all rights to trial in any action or proceeding instituted in connection with this sweepstakes or with these Official Giveaway Rules. Any controversy or claim arising out of or relating to the sweepstakes or to these Official Giveaway Rules shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the Commonwealth of Massachusetts. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE COMMONWEALTH OF MASSACHUSETTS WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Giveaway Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Giveaway Rules and/or the sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in Massachusetts. The parties agree not to raise the defense of forum non conveniens.

This sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, or Apple. 

By entering this sweepstakes, entrant accepts and agrees to these Official Giveaway Rules and the decisions of the Sponsor, which shall be final in all matters. Sponsor reserves the right to disqualify any entrant who fails to comply with the Official Giveaway Rules.
